All Contents and elements on the Website belong to the company  Baron Grafton Arthouse Ltd and are owned by or licensed to be utilised with the permission of their owners to Baron Grafton Arthouse, subject to Copyright and other Intellectual Property rights under United Kingdom and foreign laws and international  conventions. The artists, Maite Baron, Keith Grafton and Baron Grafton, as creators of the Works of Art and having taken the initiative of their creations, remain the bearers of the rights of author of her, his or their work, as defined by English Law. The rights of representation and of reproduction of any of the Works of Art presented on the BaronGraftonArthouse.com Website belong to their authors: Maite Baron, Keith Grafton, Baron Grafton Arthouse Ltd. Their conjoint authorisation is necessary for all exploitation of these rights.

NO GRANTING RIGHTS

By buying an Original Work of Art, an Open Edition Print, an Art Gift, a Limited Edition Print, or/ and any other product created by Maite Baron, Keith Grafton or Baron Grafton from Baron Grafton Arthouse, either through the website, during an Art Fair or Exhibition or through an authorised retailer, you are only acquiring material ownership of the Original Work of Art, Print, Gift or Product. No other rights are granted or implied. Any reproduction (copying), dissemination, transmission, broadcast, distribution, leasing, public exhibition or display, or other analogue or digital use in any form, medium or technology now known or later developed is not permitted unless specifically authorised by us in writing.

Your rights to the purchased “Work of Art" are therefore limited to a right to private use and to resell the artwork privately but excluding any right of representation, commercially exploitation and of reproduction. No other rights are granted or implied.

TRADEMARKS 


All of the Baron Grafton Arthouse and Website trademarks are owned by Baron Grafton Arthouse Ltd and may not be used in any way or form for any purpose without the prior written permission of Baron Grafton Arthouse.

PUBLICATIONS AND OTHER MATERIALS

Unless stated otherwise, Baron Grafton Arthouse Ltd owns Copyright and all other rights in all publications and materials supplied to you by Baron Grafton Arthouse. You may not reproduce, transmit, distribute, sell or commercially exploit these materials without the prior written consent of Baron Grafton Arthouse or to the extent expressly permitted by law.

NOTIFICATION OF COPYRIGHT INFRINGEMENT 


Baron Grafton Arthouse Ltd ("Baron Grafton Arthouse") respects the intellectual property rights of others and expects its users to do the same.

Copyright ownership is distinct from ownership of the physical piece of artwork. When an artist creates a work of art, the artist owns both the copyright in the artwork, and the physical artwork. Ownership of the copyright is an intellectual property right. Ownership of the physical artwork is a personal property right.

Your rights to a purchased “Work of Art" are therefore limited to a right to private use and to resell the artwork privately but excluding any right of representation, commercially exploitation and of reproduction. No other rights are granted or implied.

Although the client may “own” the work of art, the artist who created the work owns the copyright, including all ways in which that artwork is represented (photos, video, ads, logos, branding), other than in situ (on-site documentation photos).

Under the Copyright Designs and Patents Act 1988 (so for works produced after 1 October 1989) the author (or creator) of the work owns the first copyright in the work.

Your rights to a commissioned works of art are therefore limited to a right to private use and to resell the artwork privately, but excluding any right of representation, commercially exploitation and of reproduction. No other rights are granted or implied.
